Davis will remain on ballot, election will continue as scheduled

The Student Senate elections commission hearing board unanimously chose to suspend May Davis, vice presidential candidate for United Students, from the Senate elections that began this morning.

After two hours of testimony and 90 minutes of deliberations, the elections commission hearing board found Davis guilty of improper contact with members of the elections commission who lived in her sorority, Alpha Chi Omega.

In a decision made by Chancellor Robert Hemenway early this morning, vice presidential candidate May Davis was left on the Student Senate election ballot despite being suspended by the election committee board.  If Davis wins the seat, she will have to win an appeal of the decision.

"We find that she attempted to obstruct the hearing board in the performance of their duties and attempted to influence the outcome of the election by means of harassment and intimidation," said Alex Herman, hearing board chair, when announcing the commission's verdict.

According to testimony given by the commissioners in question, Davis approached them on multiple occasions seeking information about a commission decision to fine United Students $350 for failing to include the commission’s Web site on its campaign posters. Davis used that information to aid in her appeal of the fine.

Adam McGonigle, student body president, said United Students planned to appeal Davis’ suspension.

United Students will have 48 hours to appeal the decision to the University Judicial Board.

Elections commissioner Steven Elliot said after the hearing that the committee was unsure how to handle the situation. The committee had originally recommended that Davis' name be kept off the ballot and that Mason Heilman, United Students presidential nominee, continue the campaign.

However, later in the night, Chancellor Robert Hemenway made the decision to keep Davis on the ballot and to continue the elections as scheduled.

"Because this decision by the Elections Commission was made immediately prior to the election, and because it is appropriate for the candidate to have the opportunity for full due process under our University Rules and Regulations, I have determined that the name of the candidate, May Davis, will remain on the ballot," Hemenway said in an email to the student body. "If Davis is elected as Student Body Vice President, she will not be able to take office until after the outcome of any appeal she may make to the University Judicial Board."

Heilman said while he was upset about the commission's decision, he still planned to continue campaigning as usual.

“We do feel that the elections commission was out of bounds this evening,” Heilman said. “But other than that, I will tell you that the campaign will still go forward. United Students is far more than one person.”

Heilman said discussions had taken place regarding a replacement vice presidential candidate in the event the appeal is denied. He declined to comment on who that replacement would be.

Envision presidential candidate JJ Siler said his coalition would try to continue the campaign as planned.

“We’re going to stay focused and just get out the vote,” Siler said. “I think we have enough to hang our hat on that we don’t need to pay attention to any other coalition.”

DANGIT! I lose. :(

Even if United Students still wins, I am incredibly pleased to know that May Davis will not be running Student Senate. That was a nightmare waiting to happen. I really hope that she learns a lesson from this experience and attempts to become a nicer person.

I do not fault the judicial board.

This shows to me, a previously disillusioned person with our student government, that everyone is held accountable. That actions do have consequences(Especially considering what the Student Body President did to Alex Porte), and no one is above the rules or the laws of the bodies in which we serve.

It is unfortunate that this years election will be extremely biased because the Commission decided to hear this complaint hours before the polls open. I thought the Commission was supposed to not be political? The Commission is playing right into the politics of the coalitions. . . Shame on them!

No matter who wins this election, their victory will always be tarnished in the fact that they could not win an election based on platform issues or the individual merits of each candidate. No, The Commission had to step in and swing their mighty fist and will undoubtedly influence this election. But I guess in politics a win is a win no matter how it is accomplished! That is why I hate politicians.

From looking at most of the weak platform issues this election was never meant to be about the issues. The backlash against the decision just really shows the lack of historical knowledge that one has on elections. People have been booted before, but generally those problems occur earlier in the election cycle. I don't think you can really blame to EC for the timing of the violations.

Also I am kind of surprised that the issue of this relationship between a candidate and two members of the election commission was not an issue earlier. I remember the Kansan running multiple stories some years back when a certain Elections Commissioner happened to live with a certain Off-Campus Senate candidate. I would say the situation was roughly similar and had no coverage until now.

Maybe the incestuous nature of Senate has just grown to the point where this is acceptable.

Also this election might seem interesting compared to the snooze fest that they have become in recent year, but still not like it used to be back in the day.

Darell Stuckey would make a horrible VP. No offense, but he'd have to learn how to run a meeting. While Mr. Gillaspie has done a decent job learning how to do it this year, I think senate could benefit from having someone running it who knew more about it.

May's 4.0 in a double major along with all of her activities that she is involved in makes it hard for me to believe that she is an "air head".

I'm voting Students of Liberty even though I don't agree with much of Adam's non-campus related politics. He's a very principled person and the university needs a clean break from all this he-said-she-said BS.

i think student politics should be less about these kind of smear tactics against poor ms. davis and more about getting totally pissed at your sorority sisters when they make the wrong call, and not letting them forget it!

Will you guy seriously shut the f-u-c-k up about Ron Paul? My VP would be pissed to hear you say that because he is a Republican, and voted for a Republican, not to mention we have many democrats on our ticket. Everyone can agree on our platform if they think a little.

I personally know one of the two people involved in this and want to correct a couple of things. First, there was no "classified information". All information the EC produces is public information and in fact, that's how the Daily Kansas got the story, but just asking for it. 2nd - - both the girls involved stated that they did not feel either harassed or intimidated. Taylor said it was an intimidating situation, but only because she wasn't used to this kind of thing.

Wood, I will say this once, I will say it again. As soon as you all take yourselves seriously I will happily take you seriously.

Porte's GF is the sister of a commissioner

The commission has been acting like chickens with their heads cut off since day one. They failed to hold a candidate workshop, instead, they had candidates sign a piece of paper, hoping it was even read.

If anyone is going to be kicked out of the election, if should be the commission. A group of 4 people, half of them having ties to other coalitions feel that they can make a decision that the student body should really do.

Did I fail to mention that Porte (who filed the complaint) was not even at the hearing tonight?

don't worry. united students is rightfully going through the stages of coping. when an elections scheme full of so many opportunities for corruption has been captured by one party for so long, a little bit of unbiased decision-making should come as a shock.

this entire episode reads like a stereo type of the way the controlling party/ personalities do business.

Chasing people down the sidewalk when they literally just passed by someone in a Nancy Boyda shirt? Get real, that's not all right and is vindicative of the type of person you are and certainly the type of leadership your coalition considers acceptable.

It is not tenuous evidence. They sat in deliberations for over an hour, which says something about the evidence considering the decision was unanimous.

There 5 people, they were unanimous. If even one person was biased that does not account for four peoples votes. Keep in mind these are all law students, not ninny's from Senate. This was not biased, this was a fine decision.

regardless of whether there is classified information or these girls felt threatened by their sorority sister. based on the language of their affadavits it is by no means unreasonable to find that ms Davis

if you think that angry text messages and repeated critisism outside of the hearings can be considered 'harassment,' and you believe these communications were an attempt to influence the future decision making of the commission, Ms. Davis violated the code. the punishment for violating this part of the code can include being written off the ticket.

this is what the commission found. if you can't see HOW this could be a PLAUSIBLE decision, then your biases are in the way.

Did the two sisters say they were harassed or intimidated? One of them told me personally they did not, but I wasn't at the hearing. Of course, someone could say "Oh yes, she attempted to harass you, you're just not smart enough to know it." 2nd question...what elections commission decision-making? May was complaining about a decision already made, not one that was to be made, so influence what? I don't know, still sounds bogus to me.

you may be right currmudgeon. however, based on the sisters' language about the interaction 'angry text messages,' and because of their position as board members, it is not unreasonable to find that this was inappropriate at the least and at the most an attempt to influence FUTURE decisions.

i think the best case for may in this situation would have been something like:

"i am close with these girls and this was merely good natured complaining about a decision that i let them make with no attempt at influence. granted, because of their position as board members, i should have waited until after the election to engage them on this personal level. i overstepped my bounds, but did not mean to harass or change the outcome of any future decisions. i will gladly pay a fine, but should not be kicked off the ballot."

in the end, only davis REALLY knows what her intentions were.

as to your 'reasonable doubt' question: its not your doubts or my doubts that the fact finder has to overcome. reasonable doubt is just a standard. if YOU can see how this could be reasonably believed, then its possible that a fact finder could have had her doubts calmed by all the testimony, etc. that she presiding over tonight.

it could also be a question of language: if the facts as to her conduct were undisputed, it would presumably be within the board's power to find that this kind of personal conduct constitutes AUTOMATIC harassment because it oversteps some bound as to how a candidate should interact with members of the board.

plus, this isn't a criminal preceding and we're not exactly stripping ms. davis of her RIGHT to run for KU VP. my guess is the board just gets to make its best judgement call.

  1. If you don't like the system, get involved and fix it. Don't just sit behind a screen name and complain.
  2. You guys should do some research on other schools and how they appoint their ECs. There's some better systems to be had.

  3. Don't ever blame anyone for the timing. In any student senate election things don't happen on a perfect schedule. Would you rather the ECs just stop working a couple of days before the election in case they have to make any large decisions?

If Davis is elected as Student Body Vice President, she will not be able to take office until after the outcome of any appeal she may make to the University Judicial Board, which will review this case per University Rules and Regulations. If Davis is elected as Student Body Vice President, next week's Joint Senate Session will be chaired according to Student Senate Rules and Regulations Section 3.3.2 Hierarchy of Chairing the Student Senate Meeting.

Well, we didn't ever formally decide between Gummy Bear Coalition or Velociraptor Coalition. Either way, it never really got off the ground. We were just too busy being awesome.

The upside of our coalition: neither of us will be here next year, so we can't annoy anyone or go on crazy power trips.

I just want to clear things up: 1. who effing cares if the chair's sister is dating porte, HE DOESN'T EVEN GET A VOTE. 2. everyone is complaining the EC knows too much about senate but then people are complaining the fill ins knew too little...wow, thats dumb.

Was the elections commission strict in it's ruling? Yes. Too strict? Maybe. But May Davis SHOULD NOT win her appeal. May is the one who harassed the commission members, which is a clear violation of the election code. And the stated punishment for that particular offense is not being allowed to be at the top of the ticket. The commission does have some wiggle room with what kind of punishment they can hand down, and I don't know that the one they came out with was necessarily the most just. But it's their decision to make, and based on the evidence and rules, it's clearly an acceptable one. The case does not need to proved beyond a reasonable doubt, just based on a preponderance of the evidence (more likely to be true than not). The hearing board unanimously decided that May was guilty and should be removed. And there are no valid grounds on which the appeals board can overturn the decision.

I love that May Davis "harassed" her sorority sisters/commission members yet oddly enough BOTH testified tonight that they were not harassed and were in fact misquoted...wow who's surprised by that!? The media misquoting something? Maybe if you would have gone to the trial you would actually know what the two "harassed" women actually felt like and what ACTUALLY happened. Both women clearly stated that the situation was something they were not prepared for and they made the mistake by discussing issues it was NOT May Davis' fault. ALSO it was explained that they had to write their testimonies directly after being questioned and talked to by the whole commission which did make it appear slighted towards May being the villain in this situation. Both women made it very clear tonight that May was not in the wrong. Too bad the board - oh yes AND the female sub they brought in - have ties to other coalitions...while they may state that they are unbiased, they also must support voting..so clearly if they are voting then they have decided (especially by this point) just who they are voting for....unbiased? RebeccaJ, it's called a due process. United Students appealed, as should be allowed, and therefore Davis remains on the ballot. It's not because the Chancellor likes her, because if she's "convicted" for lack of a better term, she won't serve. So suck it.

regardless of everything that has happened: mason is baller. anyone who ever served on student rights committee under him knows he is (myself included). The kansan split-ticket endorsement was clearly prophetic. And I can't see him holding any grudges after the election, unlike some past vice presidents and presidents...

Why does The Kansan ask Envision what they think about this and not the other coalitions? First of all, WHO CARES and second of all, this doesn't have anything to do with them directly.

And why hasn't the Kansan tried to talk to May Davis? Has she been quoted in any of these stories?! Even if she doesn't comment, she should have a chance to speak her mind.

That said, I don't like United Students, but everyone should be treated equally.

Why not? Shouldn't we be practicing for the real world right now? I mean, sure, these kids are playing politics, but it'd be the same if they were city commissioner, or a Chicago alderman, or an ex-football player mayor. Or a broadcast journalism Alaskan governor hockey mom fashionista cum trooper blackballer. I say we give May Davis a second chance or five.

That's a good one! Mostly likely she will get a second chance (or five) because of the way the "real world" operates these days.

To calikufan and everyone else who thinks the board was biased - you are in Senate! You have ample ability to fix it.

And who isn't biased already. There's no way to get a board of people who don't have some tie to someone. With such a small percentage of people on this campus who actually give a darn about this stuff it's bound to be that everyone already has a tie.

In response to an earlier answer to my question about individuals having to go around themselves to sign their petition form, there are 3 United Student candidates two of which I remember (Michael Wade Smith and Darrell Stucky) had another United Students cohort asking people in her class to sign their petition for them. Is this illegal?

I find it hard to believe that anything discussed in an Elections Commission meeting could be considered "confidential". It seems like the whole problem is the lack of communication from the Elections Commission through the proper channels forced May to try and figure out what was going on by asking her friends.

kingsley - no, that isn't illegal. it's illegal to actually campaign in a class, i.e. say "vote for my coalition!" but it isn't illegal to get signatures in a class.

There's no more need for discussion. That comment explains the whole situation perfectly you cannot deny the decision of a committee just because you don’t agree with it. Other schools will look at us and laugh if they aren’t already. This entire situation is an embarrasement. No other candidate would even come close to making such an egregious offense, or get away with it but no other would be backed by the chancellor either. Dictated not read.

To clarify myself, these three individuals had someone else get their 50 signatures rather then them asking for it. Whats up with that?

First of all, I want to congratulate everyone on the level of commentary on this site. It could get heated but for the most part everyone's keeping things reasonable. Much better than some places I've been.

So I want to ask a different question: How do we fix this problem? From what I understand, everyone on the EC has ties in to somebody so there are always appearances of bias. Is it time to change the EC so that only people with NO connections can sit on it? This would mean mostly off-campus, maybe not even students. That seems nuts I guess...so what's the answer? Or, do we just say this wildly entertaining and who would want to miss it?

Well I'd say that whoever the next Studex chair is, they should just appoint the EC by the 3rd week as per rules and regs rather than waiting until coalitions are well established and their influence is felt. That way any bias naturally occurs rather than being already established

Just eliminate the EC. If there are any violations that actually deem looking into the University Judicial Board can fix them (although it might take 6 months).
The current EC is just used as a political weapon and doesn't really do anything to keep the election fair. Not to mention the election rules are a joke.

Research other schools! Don't reinvent the wheel. This conversation has happened at every school across the country.

I do disagree with her staying on the ballot though.

If I'm convicted of murder by a lesser court, I don't stay out of jail while my appeal goes through. Instead, I'd wait behind bars, just like May should.

The judicial board should have power to appoint an Elections Commission.

There should be one or two ECs appointed from each of the different areas ... the pres, the senate and the judicial board.

the elections commission was so biased in this instance. its still unbelievable that the chairs sister boyfriend is the one who filed the complaint. This just seemed like it fired up the candidates of United Students. They were definitely out in force today....if I got approached one more time by them I wouldve jumped off of Frasier. good luck to them though...this is definitely one of the most entertaining campaigns of my 5 years here

Look, we can all agree that this he-said-she-said bs isn't the way to run our Student Senate; especially not when it has such power in our everyday lives and handles such a massive amount of money every year. If we all want a real fix to this problem than the solution is simple; elect people that are for common sense, vote fellow students into office that actually care about the University and all of the students on it, not just one or two groups. Today and tomorrow get online and vote for people that actually care about helping you, not someone that wants political gain.

The main problem with that, Wint, is that nobody knows who stands for what. The voting records are sparse and difficult to access, the Kansan asks shallow questions, and the platforms are overwhelmingly similar to outsiders.

The people who vote (all 18% of them, last year) typically know the candidates they vote for personally and vote for them based off of that.

I have a suggestion for how to fix the incestuous election cycle. A campus forum, lightly moderated, tied to KU online IDs, for allofus students, employees and faculty (people this matters to) to discuss stuff going on. Like, for instance, this. And everything leading up to this.

There was an attempt at something similar to that through Senate, pantheon. I'm not sure if it was successful or not. Adam would know, I think he posted on it frequently.

Actually Taylor wasn't appointed by Mason. She was asked by the commission to fill in because someone else left.

Oh and only four members actually vote on the hearing board. Of the four that voted last night, only one was a law student if I remember correctly. The fifth member who is in the room during the deliberation, the hearing board chair, is a law student but only has a vote in the event of a tie.

To clear May...she is a very intelligent, gifted, and driven to do her best. Period. This sounds like a couple of sorority sisters that felt intimidated by her will to win. The will to win can sometimes scare people with no confidence in themselves. For you "sisters",or my fav. " Using daddy's money to join a female cult, who can't make friends in a normal REAL world!" there's been some people talking about how much they want to focus on issues and move past "dirty" politics. The thing everyone needs to realize is, this is student senate. Student senate can't access real social issues like stem cell research or economic policies like fiscal conservatism or any of the other national issues that actual politicians focus on.

So if you stop and think for one second, what, exactly do you want them to discuss? The merits of attempting to put in better lighting in the student ghetto vs the merits of attempting to allow you to go to the rec a few times without a pass?

This is a University. People are here to learn. If our aspiring politicians are to succeed later on then they need to know how to succeed in maneuvering through "politics" as well as addressing issues. Since there's no real issues in student senate, let them have their politics!

On the other side of the coin it's kind of disconcerting to realize that many of these people are going into real politics. If they can't be idealistic and uncorrupt while in college, at the most idealistic point in their lives, imagine what they'll be like in higher office.

Actually, -10 exp for my bad grammar. I actually meant "can't be trusted" in that second point of the last paragraph. I epically fail.

All of this is really a moot point now that Ms. Davis is back on the ballot, regardless of the fact that she'll be barred from holding office if she wins, the option to vote for her is still there. If the option to vote for a known-corrupt politician (the Elections Commission hearing is a public event, anyone could attend and bear witness, and the results were known by the majority of potential student-voters within hours of the event) is present, then it weakens the voter's faith in all of the other candidates on the ballot.

If nobody knows what any of our candidates stand for, and the few of us that vote are only voting for them because we know them personally in the first place, then why do we have student senators to begin with?

It undermines one of the core, foundational assumptions of our republican system of government both here at KU and in our society as a whole if you can't trust in the candidates running for office - let alone the Senators actually in office.

This speaks of major issues that need to be addressed in the way we conduct our Student government - immediately. I think too many of us are overlooking two critical facts here; 1) our Student Senators are in charge of massive amounts of money, and are capable of affecting our every day lives in several, colossal, ways - from raising our lower student fees to the services offered by the University, to the rules and regulations that we all must live by; 2) as connerm points out, this is an academic setting. If a student entering into law/politics can be trusted even at the "simple" and "lowly" level of a college Student Senate, than how could they ever be trusted in any other position of power?
