Executive Committee votes to uphold Porte’s suspension

The Student Executive Committee ruled to uphold Student Body President Adam McGonigle’s decision to suspend Treasurer Alex Porte Wednesday night after 45 minutes of arguments and questioning.

More than 60 people crowded into Alcove J in the Student Union to hear the appeal and await the final decision. The committee voted 5-3 in favor of overturning the suspension. However, the two thirds majority needed to overturn it was not met.

Student body president Adam McGonigle suspended Porte from his duties as senate treasurer on March 3 after he determined that Porte had leaked a confidential memo to The University Daily Kansan concerning student fee adjustments. Porte's and McGonigle's accounts of the events leading to Porte's suspension differed on several major points including the chronology of the events.

McGonigle and Porte each presented their arguments for about ten minutes before allowing for questions from the committee.

In their presentations, McGonigle and Porte explained their perception of events, beginning with a confidential meeting held between certain members of the fee review subcommittee. Neither McGonigle nor Porte disagreed that information presented at that meeting was asked to be confidential. However, after the meeting, Porte released a memo at the request of The University Daily Kansan which detailed McGonigle’s recommendations to cut the campus safety and campus media fees while allowing for slight increases to the Senate Activity Fee, which would fund minimal salary increases for senators.

After this release of information, McGonigle said he felt it was necessary to discipline Porte for a breach of confidentiality.

“If you disagree with a decision that your supervision makes, you tell them about it,” McGonigle said in his presentation. “You discuss it with them, but you certainly don’t blindside them by taking it to a media outlet without any other expression of concern.”

Porte argued that withholding the information violated Student Senate Rules and Regulations, which states that any program or activity funded by student fees should be open to the public.

McGonigle asked Porte to write a letter of apology in exchange for keeping his job. Porte submitted one letter to McGonigle who made several edits. Porte revised and resubmitted his letter.

“Among his recommendations he demanded that my letter include such things as my personal desire to apologize and the profound ethical implications of my actions,” Porte said. “These are demands that I cannot meet because I do not believe them to be true.”

McGonigle said the letter did not include “a real admission of wrongdoing” and suspended Porte after he failed to write an apology letter that fit his qualifications.

Other arguments during the appeal focused on whether the student body president had the power to suspend an executive staff member for a breach of confidentiality.

In Student Senate Rules and Regulations, the Student Body President has the power to remove executive staff members from office if they have violated their job description or the office policy manual.

Porte contended that no such violation had occurred and that the suspension was unlawful.

After the arguments, the Student Executive Committee went into a closed deliberation session that lasted about 25 minutes before announcing their decision.

“It obviously didn’t go my way,” Porte said after the ruling. “I’m shocked more than anything else.”

Eric Foss, a voting member of the Student Executive committee said the main reason cited by senators for upholding the suspension was an article in Rules and Regulations that states the Student Body President has the oversight to “review job descriptions, direction of employees, enforcement of the office policy manual and disciplinary procedures including removal by appropriate means if necessary.”

Foss said he thought using that article to uphold Porte’s suspension was a very broad interpretation of the article that overextended the powers of the Student Body President.

“It essentially gives the president the authority to treat executive officers as employees,” Foss said. “Their interpretation allows the president to unilaterally make decisions.”

Bill Walberg, Eldorado Hills Cal, senior, said he voted to uphold the suspension because he thought the article did give power to suspend executive staff members to the student body president. “Even though it gives a gross amount of power to the president, even though I may not necessarily agree with it, it is in there,” Walberg said.

McGonigle said he did not feel he overstepped his boundaries and said he would not change his actions.

“I acted appropriately and though I think this situation is regrettable, my actions were consistent with policy and with the goal of moving this situation forward and moving on with the work of the student body,” McGonigle said.

McGonigle said he would give Porte the opportunity to resubmit another letter of apology and would reinstate him as student senate treasurer if that letter met his qualifications.

Immediately following the appeal Porte said he had not decided on his next course of action.

You know, I wouldn't have any problems with this suspension if Porte had done anything wrong. Like, actually wrong. For instance, concealing information from the student body.

It's too bad the article doesn't mention May Davis doodling during Alex Porte's speech. She, of course, was also one who voted to keep the suspension. Please, NOT United 09-10.

I'm glad I'm a graduating senior. I've about had it with student senate and president McGonigle.

Tomorrow's leaders? Hardly. This is just a breeding ground for the same gamesmanship that adults play at. Don't you guys want to be different than the crap the world has already given us? How about real government in the sunshine, how about tabling petty squabbles, how about not holding a person's job over their head unless they capitulate and agree with you?

This weasel wanted to cut funding to the Kansan, KUJH, KJHK, Kiosk Magazine, KUpedia and KU Filmworks while allowing for salary increases for student senators. Our treasurer leaked the memo and our student dictator suspended him for making him look like a weasel. And I know May Davis and think she's cool (And hot), but how could you vote in favor of this loser? You're a journalism student too ya freakin sell out!

I like how the senate keeps the impeachment committee to eight members, so Porte really needed 75% to get the decision overturned. If the committee needed to have a 2/3 majority to do something, maybe the committee should be able to be divided into thirds.

OGL - I think Mitch is capable of handling most of the duties. But it still is a big void not having a treasurer with the experience that Porte has, and McGonigle is hurting Senate during a pretty important time financially by suspending him.

I'm glad Porte was suspended. He went around his boss' orders when the information wasn't even finalized and cause so much drama. He politicized this event through the media and then over again through countless facebook messages. If he were to do that in a real job, his ass would have fired immediately as it compromised a very delicate process. Oh and if you have a problem with the rules change them, because the President clearly had the power to do this.

WOW! United Students has now stooped low enough that they are creating fake accounts on kansan.com, labeled envision09, to try and sway the student's opinion. When will it end? Why would someone who makes an account called envision09 to rail against Porte? Everyone in Senate knows he has done a fantastic job as Treasurer. Grow up, US.

April 15th and 16th, VOTE!

I'm not going to hold United Students to the innappropriate action of one member on this site, but I will say that posting under Envision is not fair play, and neither was the drama surrounding Alex in general. The Alex-Adam situation has distracted everyone from campaigning for Senate these last two weeks on REAL issues. I do not blame Alex for that,though because as he said yesterday at the hearing, he (I and other members of Envision, too) never expected this situation to escalate to this level - he was just trying to do the right thing. This shouldn't have become a political issue, but that is not the fault of Envision. Student Senate needs ethical reforms, and this is a clear example of why an independent judiciary is needed as well as a reduction in executive power. If this is what Envision has to use to show students how "gross" as Bill said the president's power is on this campus, then let it be so.

As far as the vote, one person abstained, making the vote 5-3. So, there were nine people there. However, I too am upset that the only three people who voted to uphold his suspension were journalism students. I am friends with these students, but I have to say I was disappointed. As a journalism student too, I feel that Alex really helped us out before it was too late. The only people who voted against Alex were United Students people as well. I am not going to link these two happenings further than that, as I have a lot of respect for Jay specifically and I have not asked him his reasonings in private for this decision, but I do think it would have been in May's best interest as a candidate (coming from someone in media relations and campaign management) if she had voted to reinstate Alex and then told The Kansan US wants a fair election etc etc etc. That would have made her look very ethical and admirable.

Yes I agree we need an independent judiciary branch, but StudEx is almost just as independent as the US Supreme Court. It is made up of five standing committee chairs voted on by senators and non-senators. 3 SenEx reps voted in by the full Senate and the President and Vice President. I'd call that relatively independent. What happened was fair and get over it...FYI why should the Kansan be upset about losing funding? They report on Student Senate but they sure aren't fair. The editorials calling to go against the current administration and support the new coalition are disgusting. They're only supporting Envision because they don't want to lose their funding. If you are angry about this - if you feel anything was unjust - don't just write a comment on a webpage - DO something!

Envision > Harness and embrace this. While I'm sorry to see the turmoil it has caused him, I'm happy Alex was removed from any administration that would go to these lengths. He deserves better than this. YOU as students deserve better than this. Teach the students why you are different than Adam. Teach the KU students how much more you can bring than United Students, who for some reason believe they are entitled to exist in complete disregard for their duties and responsibilities as leaders and representatives. I know you can prove yourselves. Transform your anger into energy to move onward and upward.

Students > Take this as a sign that you must be more aware of your student government! It exists for the sole purpose of providing for you. Ask questions about what they are doing with your money and how they are operating. You paid them a large amount of money to provide a service. Are you receiving that service? Ask Adam, ask anyone on United Students, ask anyone who voted to uphold the suspension how they can justify a clear disregard for their own rules and regulations.

calikufan, or can I just address you by your full name, Bill Walberg? I question your morals both as a member of student senate and the president of SUA. Voting as you did in committee allows McGonigle to keep secret information that should be public to everyone. Voting as you did harms the students you are supposed to be representing. Going on The Kansan webstie and posting "anonymously" is also morally questionable considering your role in the upholding of Adam's suspension of Alex. You are a political hack.

StudEx is nowhere near as independent as the US Supreme Court because the members of StudEx are nearly all members of both the executive and legislative branch of our student government. For some reason I have yet to see a Chief Justice also serve as Secretary of State and the senator from Wisconsin. Oh yes, that's right, that principle would be SEPARATION, not conglomeration, of powers.

Furthermore, in all honesty US probably doesn't care about how this affects them politically because they have the money and impersonal shotgun approach to campaigning that allows them to take significant political blows i.e. this affair, as well as financial hits i.e. the thousand dollars or more of fines they will have racked up by the time the election is over.

As if that weren't enough, this UDK article was so hellbent on being non partisan that it didn't go deep enough to address the implications of Adam's actions. By allowing Adam to fire Porte StudEx has set the precedent that Senate office personnel are employed by Adam and not by the state. That may seem like a stretch but it's the only explanation that allows Adam to fire Porte without providing A SINGLE RULE to justify the suspension in the hearing.

Therefore let me advise that the Comms director, VP, assoc treasurer all watch their backs as now Adam has the right to suspend you if he isn't able to keep you under his thumb. Though I doubt that will happen because as May Davis admitted personally to me, United Students thinks and "votes as a block."

(I have to agree, great job on the avatar Bill. Unless of course transparency was what you were going for. But we know that's not true with anyone from United Students.)

Seriously, being without Porte is obviously having a big blow in Finance and Senate as a whole.

Example 1: Finance Committee this week - Porte was deferred to many times (as he doesn't have speaking rights since he's not technically a member yet) because his advice was so vital to the proceedings.

Example 2: "It's also great that Diana Rhodes will be forced to pick up this mess, because we're all aware the Mitch Knopp can't." -- Mitch seems like he can do an adequate enough job (at least let us limp through), but he has a lot to learn. Diana WAS helping him today. [Though to his credit, it was only one instance that I'm aware of].

Example 3: I can't wait until full Senate gets to discuss block without Porte. This should be good.

I know I've said it a million times - but you Envision people don't seem to understand. The "secret memo" was actually made public by McGonigle himself about a month ago.

It's kind of sad that a JOURNALISM school senator can't tell the difference between the opinion section and the news section.

Haha...well I'm glad everyone had so much time to figure out who I was. But listen here folks...leave SUA out of this...when I made this decision it was as a member of StudEx. This is Senate discussion...and yes I know the difference between the Opinion and the News section except many times it is blurred. And lastly, you all are just so upset it didn't go your way. I made my decision based on a nonpartisan persepctive...I met with both guys for an hour beforehand. But unfortunately, there was language in Rules and Regs that supported Adam's decision. I just cannot believe how disrespectful and disgusting you people are. Adam is a great kid who has done great things for this campus. Same with Porte, but he screwed up and he's going to fix it. You may be shouting Open Meetings Acts or censorship, but get the facts right. I bet 99% of you posters don't have all the facts because you never asked the opposing views. Do what I did talk to Adam and Porte and get their stories....that's true Journalism. Oh and if you don't talk to both sides....that's true ignorance.

I should say I don't expect you to respond because the fact of the matter is that nothing in regs supports what Adam did. You voted the way you did because you will do whatever McGonigle says. Some day, I hope you will learn how to think for yourself.

Reason...first off the kids younger than me. Second off no one tells me what to do. Thirdly, read rules and regs and you'll find out that Adam can give direction to his employees...what good is to do if he can just hire people and have them not listen to him. If you don't have control over your employees what good is it to have them in the first place?

However, Porte is not employed or paid by Adam.

Therefore, he had no right to fire him on these grounds. Essentially you're saying that because Porte upset Adam by "not following his directions" Adam has the right to suspend him. If this is true then I suggest you watch your back as well. Though by voting in line with him I doubt that will happen.

Haha Jhitt...I was not hired by Adam and no voting member on the committee was, but Porte was. Now don't get me wrong, Porte's a great guy, but just made a mistake. He just has to write a letter and he'll be good to go.

But I would like to pose the question to everyone out there attacking myself and Adam...reveal yourselves. I've already given you the language that I thought was correct...the President can give "direction" to his employees. You may not agree with it, but that was my interpretation. When you are elected by the Senate to the Student Executive Committee with 60 people around you watching and waiting for a decision, you're going to have people disagree with the way you voted. Trust me it was my most difficult vote I have had to make. FYI...anonymity is weak. That's the problem with things like this and Juicy Campus. Anything can be said without worrying.

That's what I interpreted. You can address me in every post by my full name everytime you want...I think people got the point. 4.1.8.1 reads: The Student Body President is responsible for direct oversight of the executive officers, the Student Legislative Awareness Board Legislative and Community Affairs Directors, and the Staff Secretary. This oversight shall include, but not be limited to: reviewing job descriptions, direction of employees, enforcement of the office policy manual (Appendix L) and disciplinary procedures, including removal by appropriate means if necessary in accordance with Article IV, Section 14.

Section 14 has to do with election commission rulings, so I would guess that 4.1.8.1 was never amended and intends to read section 15 instead. 4.15.2 reads:

"The Student Body President shall have the power to suspend or remove from office the following members of the Student Senate Executive Staff if they are not meeting the job descriptions or as described in the office policy manual (Appendix L) set by the Student Body President and Student Senate Rules and Regulations: the Legislative Director, the Community Affairs Director, the Student Senate Communications Director, the Student Senate Deputy Communications Director Technology and Advertising Director, the Student Senate Executive Secretary, the Assistant Treasurer, and the Student Senate Treasurer."

The only way Adam can remove Alex is for Alex not doing his job. How did Alex not do his job?

Oh reason...you still have yet to hold up your end of the bargain...but anyways. Two points...Porte is employed by Adam, he hired him. Secondly, if one of Adam's employees, like Porte or Aly Rodee, the Comms Director made threats or stole something, that is not in the job descriptions or office policy manual.

CASE IN POINT: Porte is employed by the state, supervised by Adam. If someone had a problem with Adam's decision, his supervisor, the Provost/Chancellor would have stepped in. Porte, unfortunately, released a memo that was asked to be kept quiet and disobeyed his supervisor. Again, he's a great kid and I hope he makes amends and writes that letter to Adam's standards.

Someone who consistently tries to call my interpretation false, says I work for Adam and says I do not have a mind of my own is obviously mislead. Let's call it the way it is. You are the one who started posting on here under your "calikufan" name. If you had really wanted everyone to know who you were when you posted on here, your screen name would have had your name in it. Instead, I had to unmask you and call you out for what you were saying.

In terms of you being United Student's "yes" man, your argument for why you aren't is that A: Adam McGonigle is younger than you and B: you "do what you want." Isn't what you want is to be on United Student's good side? To get that, you are going to have to vote the way United Students wants you to vote. Seeing as how Adam is president, that means voting the way Adam wants you to vote, which you did. That is why you are their "yes" man.

If you really want to find out who I am, give me what I've been looking for: a provision in Senate rules and regs that allows the president to dismiss the treasurer for not doing what the president wants him to do (as opposed to the treasurer not doing his job). The provision you cited only allows for dismissal of not doing your job. I find it hard to believe that keeping secrets from the student body is in the treasurer's job description.

A few points:

  1. "Again, he's a great kid and I hope he makes amends and writes that letter to Adam's standards." -- You hope Alex types and signs a letter that would in all actually really be what Adam wants him to say? He wrote some drafts and none of them will be good enough unless he puts in what Adam wants him to. Alex won't and should not do that.

  2. It was remarkable how much Alex Porte was deferred to in Finance Committee on Wednesday. It's clear we need him to be treasurer.

  3. Well, if Adam can fire those who aren't doing their jobs, than why hasn't he fired Aly Rodee? I STILL don't have any orgs to outreach to and I know I'm not the only senator that feels this way.

I think Adam McGonigle is so corrupt. He has stacks of money in his office ceiling. You better watch out once he is done with his term. He'll be carrying bank bags full of C-notes because he has stolen millions from all of you! Thank you Jbrooks09 for all of the enlightening information. I feel so much more informed and smarter. Oh Jessica Brooks..and everyone else on this board. If you have a problem with Adam or Aly tell it to their faces please. You guys are absolutely hilarious bickering about things on here when those of you on Senate (most of you) can just talk to Adam or whoever else you have a problem with. This is so entertaining...I'm not complaining. I'm just giving my opinion. I've never met these people before. I would love to talk with them about this in person. Reason...you still crack me up. I respect that...but what I don't respect is you and others attacking people on message boards. My opinion is that you are a coward both in the way you voted in Porte's suspension and by attempting to post on the Kansan website anonymously. You may think you don't let other people dictate your vote, but you do let your personal ambition dictate your vote. I would recommend the next time you are in this position, you rely more on your sense of right and wrong. Of course, that would require you to actually have a sense of right or wrong.

As far as "wishing me the best in reaching adulthood," I guess that not all of us are as fortunate as you in being able to look like we are in our 40's when we are in our early 20's.

If you understood the English language, you would be able to read the code and see nothing lets McGonigle do what he did. If there was something, you would have brought it to everyone's attention by now.

Like we discussed earlier, the section you cited only allows for the dismissal of the treasurer for not doing his job. That means either:

A: You need to show keeping secrets from the student body is in the job description of the student body treasurer or

B: The section you cited isn't pertinent.

You've provided evidence of neither and until you hold up your end of the bargain, I have no reason to hold up mine.

While Alex may not have been "fired" in the strictest sense of the word, in all practical purposes his by being suspended. From what I hear he doesn't have a mail box in student senate office and he no longer receives a paycheck. If that's not fired I don't know what is. Get YOUR facts straight.

I never said it wasn't pertinent. All I said is that you never explained how it was pertinent. If it is pertinent, you need to show that it was Porte's job to keep secrets from the student body. You haven't shown that. Besides, how can you claim I wasn't at Alex Porte's suspension hearing? You don't even know who I am.

If you really made the right decision, why did five of the eight people vote against you? If I were you, I would take a step back and really ask who gives student senate a bad name: an anonymous blogger on a newspaper article or a political hack like yourself who compromises his integrity to do what the boss wants.

Oh my goodness...I DO NOT WORK FOR ADAM! I was elected by the full body to represent Senate on SenEx. And is the right decision always decided by the majority. And it was pertinent because regardless of what Adam asked Porte to do. He's his boss...and has the right to direct Porte to do whatever pertains to the good of student senate. If you really and seriously have a problem with Adam's decision and the result of this committees decision, then I would file an impeachment charge. Because everyone went quiet after this was over.

And I still do not understand what a political hack is? And I have not once compromised my integrity for student senate. How do you bring these charges against me? I have not once done something I regret as I believe everything I've done has been for the better of the student body.
